Assistant Attorney 1 
  • For appointment to the Assistant Attorney 1 you must have: Law school graduation and/or eligibility for the NYS Bar Admission.
Assistant Attorney 2 
  • For appointment to the Assistant Attorney 2 you must have: Admission to the NYS Bar.
Assistant Attorney 3 

For appointment to the Assistant Attorney 3 you must have: 12 months as an Assistant Attorney 2, or Admission to the NYS Bar and 12 months of subsequent satisfactory legal experience.

Senior Attorney
  • For appointment to the Senior Attorney, you must have: 12 months as an Assistant Attorney 3, or Admission to the NYS Bar and 24 months of subsequent satisfactory legal experience

OR

Competitive Minimum Qualifications:

70.1 Transfer:

For a 70.1 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 70.1 title allocated to a salary grade 23 or above.

52.6 Transfer:

For a 52.6 transfer to the Senior Attorney, SG-25, you must have one year of permanent competitive service in an approved 52.6 title allocated to a salary grade 23 or above and must have 12 months as an Assistant Attorney 3 OR admission to the New York State Bar AND 24 months of subsequent satisfactory legal experience.

Duties

Assist Bureau of Contracts with Legal Issues Relating to pre-audit of State Contracts
  • Assist Bureau of Contracts in responding to legal issues arising out of its review of contracts and contract amendments, and vendor responsibility issues. 
  • Review and analyze issues raised in bid protests and appeals of agency level bid protest determinations. 
  • Prepare bid protest determinations. 
Assist Bureau of State Expenditures with Legal Issues relating to the pre-audit of State Payments
  • Assist Bureau of State Expenditures in responding to legal issues arising out of the Bureau’s pre-audit of State payments, its post-audit review of such payments, and the Comptroller’s ability to offset debts that are due and owing to the State. 
  • Review and edit draft reports prepared by the Bureau.
Provide General Legal Support to the Office of Operations 
  • Conduct legal research of statutes, decisions, opinions and other legal sources to respond, both orally and in writing, to requests for legal opinions. 
  • Provide presentations to OSC program staff or other State agency staff on relevant legal issues related to OSC operations. 
  • Analyze legal issues relating to the reporting of unclaimed funds to the Office of Unclaimed Funds.
Review, Analyze and Comment on Changes in Law and Judicial Decisions that affect OSC Office of Operations 
  • Review and provide comments on proposed and enacted legislation, and court decisions, that impact OSC operations.

Desired Competencies

Preferred Qualifications: 

  • Attorney admitted to practice in New York or eligible to take the NYS Bar exam
  • Two years’ legal experience.
  • Excellent written and oral communication skills. 
  • Ability to organize large volumes of factual and legal data into clear and logical sequences.
  • Ability to identify legal issues, governing precedent and issue sound legal opinions. 

Additional Comments

This position is located within the Division of Legal Services State Finance Unit.  The incumbent would assist the Bureau of Contracts with legal issues relating to pre-audit of State Contracts, assist Bureau of State Expenditures with legal issues relating to the pre-audit of State Payments and provide general legal support to the Office of Operations. Please submit a writing sample along with a resume and cover letter if interested in this position. 

Telecommuting

The Office of the New York State Comptroller (OSC) supports telecommuting where it is reasonable to do so based upon the agency’s mission and operational needs. Generally, employees new to OSC will be restricted from telecommuting for at least 8 calendar weeks. After the initial 8 calendar week restriction, if an employee’s primary residence location, duties, and work performance are aligned with telecommuting and operational needs they may be allowed to do so. Generally, OSC employees may telecommute up to 5 days per pay period but may be approved to telecommute less.
